Marketplace Product Terms

Summary
These terms govern the sale and purchase of physical products through the Bubba marketplace. Bubba acts as an intermediary — the contract of sale is between you and the Seller. You have a 14-day withdrawal right and a 2-year legal guarantee on all products purchased.
These Marketplace Product Terms ("Product Terms") govern the sale and purchase of physical products ("Products") through the Bubba marketplace by partner shops ("Sellers"). These Product Terms supplement the Pet Owner Terms & Conditions (for buyers) and the Business Terms & Conditions (for sellers).
- Scope & Applicability
1.1 What These Terms Cover
These Product Terms apply to all purchases of physical products listed for sale by Sellers through the Bubba marketplace, including:
- Products listed directly on the Bubba platform by Sellers.
- Products synchronized from external e-commerce platforms (Shopify, WooCommerce) to the Bubba marketplace.
- Products purchased through a Seller's dedicated store page on Bubba.
1.2 Relationship Between Parties
- Bubba acts as an intermediary. When you purchase a Product through the marketplace, the contract of sale is between you (the buyer) and the Seller. Bubba is not the seller of the Product.
- Bubba facilitates the listing, discovery, ordering, and payment processing of Products but does not manufacture, stock, warehouse, ship, or deliver Products.
- Sellers are independent businesses responsible for Product quality, description accuracy, fulfillment, shipping, and compliance with applicable product safety and consumer protection laws.
1.3 Relationship to Other Terms
These Product Terms are read together with:
- Pet Owner Terms & Conditions — general platform usage terms for consumers.
- Business Terms & Conditions — terms governing the Seller's relationship with Bubba.
- Privacy Policy — how personal data is handled.
- Refund & Cancellation Policy — for service bookings (Product-specific refund and return terms are in Section 6 below).
In the event of a conflict between these Product Terms and the general Pet Owner Terms & Conditions regarding Product purchases, these Product Terms prevail.
- Product Listings & Information
2.1 Listing Accuracy
Sellers are responsible for ensuring that their Product listings contain:
- Accurate and complete descriptions, including material composition where relevant.
- Correct pricing in euros (EUR), inclusive of VAT where applicable.
- Clear photographs that accurately represent the Product.
- Availability and stock status.
- Shipping information, including estimated delivery times and shipping costs.
2.2 Pricing
- All prices displayed on the marketplace are in euros (EUR) and include applicable VAT unless explicitly stated otherwise.
- The total price shown at checkout, including shipping and any applicable fees, is the final price.
- An online payment processing fee applies to Product purchases.
2.3 Product Safety & Compliance
Sellers must ensure that all Products listed on the Bubba marketplace:
- Comply with applicable EU product safety regulations, including the General Product Safety Regulation (EU) 2023/988.
- Are not subject to any recall or safety warning.
- Include required labeling and safety information.
- Comply with EU chemical regulations (REACH) where applicable (e.g., pet shampoos, grooming products).
Bubba reserves the right to remove any Product listing that we reasonably believe poses a safety risk, violates applicable law, or breaches our content policies.
2.4 Prohibited Products
The following Products may not be sold on the Bubba marketplace:
- Products harmful to animals (e.g., products containing substances toxic to pets).
- Counterfeit or infringing Products.
- Prescription veterinary medications (over-the-counter supplements may be listed with appropriate disclaimers).
- Live animals.
- Products that are illegal to sell under EU or Lithuanian law.
- Products subject to active safety recalls.
- Any Product that Bubba determines to be inappropriate for the platform at its reasonable discretion.
- Ordering & Payment
3.1 Order Process
- Browse & Add to Cart — You select Products from one or more Sellers and add them to your cart.
- Checkout — You review your order, enter shipping details, and confirm the total price (including shipping and fees).
- Payment — Payment is processed by Adyen. You pay the full amount at checkout.
- Order Confirmation — You receive an order confirmation by email and/or in-app notification with your order details and estimated delivery.
- Fulfillment — The Seller fulfills your order (packs and ships the Product).
3.2 Contract Formation
A binding contract of sale between you and the Seller is formed when you receive the order confirmation from Bubba on behalf of the Seller. Before that point, adding items to your cart and proceeding to checkout constitutes an offer to purchase.
3.3 Multi-Seller Orders
If your order contains Products from multiple Sellers, each Seller's portion constitutes a separate contract of sale. Cancellation, return, or issues with one Seller's Products do not affect your contract with other Sellers in the same order.
3.4 Payment Processing
- Payments are processed by Adyen (adyen.com), our PCI-DSS Level 1 certified payment processor.
- Bubba holds the payment and distributes the Seller's share after applicable commission and fees are deducted.
- Payment methods accepted: as displayed at checkout.
- Shipping & Delivery
4.1 Shipping Responsibility
Shipping and delivery are the responsibility of the Seller. Bubba does not handle logistics, warehousing, or fulfillment.
4.2 Shipping Information
Each Seller specifies:
- Available shipping zones (geographic areas they ship to).
- Shipping costs per zone.
- Estimated delivery times.
This information is displayed on the Product listing and at checkout.
4.3 Delivery Issues
If a Product has not arrived within the estimated delivery window plus a reasonable buffer (typically 7 business days beyond the estimated date):
- Contact the Seller through the Bubba platform chat.
- If the Seller is unresponsive or unable to resolve the issue within 14 days, contact Bubba at legal@bubba.pet for assistance.
- You may be eligible for a refund in accordance with Section 6.
4.4 Risk of Loss
Risk of loss or damage to Products passes to you upon delivery. For the purposes of this section, "delivery" means the moment the Product is handed to you, to a person designated by you, or to the carrier chosen by you (if different from a carrier proposed by the Seller).
- Consumer Withdrawal Right (Right of Return)
5.1 Your 14-Day Withdrawal Right
Under the Consumer Rights Directive (2011/83/EU), you have the right to withdraw from a Product purchase within 14 days of receiving the Product, without giving any reason.
The withdrawal period expires 14 days after the day on which you (or a third party designated by you, other than the carrier) physically receive the Product. For orders with multiple items delivered separately, the period runs from receipt of the last item.
You have 14 days from the date you receive a Product to withdraw from the purchase, no reason needed.
5.2 How to Exercise Your Withdrawal Right
To exercise your withdrawal right, you must inform the Seller of your decision by a clear statement. You can do this by:
- Using the Model Withdrawal Form provided on our website.
- Sending an email to the Seller through the Bubba platform messaging system.
- Sending an email to legal@bubba.pet, and we will forward your request to the Seller.
You must send your withdrawal communication before the 14-day period expires.
5.3 Return of Products
After communicating your withdrawal, you must return the Product to the Seller within 14 days of sending the withdrawal notice. You bear the direct cost of returning the Product unless the Seller has agreed to bear it or failed to inform you that you must bear the cost.
The Product must be returned in the same condition as received. You may examine the Product as you would in a physical store, but you are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Product.
5.4 Refund After Withdrawal
The Seller must refund all payments received from you, including the delivery costs (except additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered), within 14 days of being informed of your decision to withdraw.
The refund is processed through Bubba's payment system using the same means of payment you used for the original transaction. The Seller may withhold the refund until they have received the returned Product or you have provided evidence of having sent it back, whichever is earliest.
5.5 Exceptions to the Withdrawal Right
In accordance with Article 16 of the Consumer Rights Directive, the withdrawal right does not apply to:
- Products sealed for health protection or hygiene reasons that have been unsealed after delivery (e.g., opened pet food, opened grooming products).
- Products that are made to your specifications or clearly personalized (e.g., custom pet collars with engraving).
- Products that are liable to deteriorate or expire rapidly (e.g., fresh pet food, perishable treats).
- Products that are inseparably mixed with other items after delivery.
The Seller must clearly indicate at the point of sale if a withdrawal exception applies to a Product.
- Returns, Refunds & Non-Conformity
6.1 Non-Conforming Products (Legal Guarantee)
Under EU consumer protection law (Directive (EU) 2019/771), you have a legal guarantee of conformity for Products purchased through the marketplace. Products must:
- Correspond to the description, type, quantity, and quality specified in the listing.
- Be fit for the purpose for which products of the same type are normally used.
- Possess the qualities and performance capabilities that are normal for products of the same type.
If a Product is non-conforming (defective, not as described, or not fit for purpose):
- Within the first year of delivery, the non-conformity is presumed to have existed at the time of delivery (burden of proof is on the Seller).
- You have the right to have the Product repaired or replaced free of charge, or if this is impossible or disproportionate, to a price reduction or full refund.
- The legal guarantee applies for 2 years from delivery.
6.2 How to Claim
To report a non-conforming Product:
- Contact the Seller through the Bubba platform chat.
- Describe the non-conformity and provide photographs if possible.
- The Seller must respond within 14 days with a proposed remedy.
- If the Seller is unresponsive or you are unsatisfied with the proposed remedy, contact Bubba at legal@bubba.pet for mediation assistance.
6.3 Seller Refund Obligations
Refunds are processed by Bubba through Adyen on behalf of the Seller:
- Withdrawal right refunds: Within 14 days of the Seller being notified of withdrawal.
- Non-conformity refunds: Within 14 days of the Seller agreeing to a refund remedy.
- Undelivered Products: Within 14 days of the claim being validated.
- Refunds are returned to the original payment method.
6.4 Seller Return Policies
Sellers may offer return policies that are more generous than the statutory withdrawal right (e.g., extended return windows, free return shipping). Such additional policies are displayed on the Seller's store page and Product listing. Seller return policies cannot restrict or reduce your statutory rights.
- Seller Obligations
7.1 Compliance
Sellers must:
- Hold a valid business registration and any required licenses to sell the Products they list.
- Comply with all applicable EU and national laws regarding product safety, labeling, and consumer protection.
- Comply with the Business Terms & Conditions.
- Respond to buyer inquiries and complaints within a reasonable timeframe.
7.2 Fulfillment
Sellers must:
- Ship orders within the timeframes stated in their listings.
- Provide tracking information where available.
- Package Products securely and appropriately for transit.
7.3 Tax Obligations
Sellers are responsible for their own tax obligations, including VAT collection and remittance. If a Seller is VAT-registered, prices must include VAT. Bubba does not collect VAT on behalf of Sellers.
- Product Reviews
8.1 Review Eligibility
You can leave a review for a Product after receiving and using it. Product reviews follow the same rules as service reviews, as described in our Reviews & Ratings Policy:
- Only verified purchases can leave reviews.
- One review per Product per order.
- Reviews are subject to moderation.
8.2 Seller Replies
Sellers can reply publicly to Product reviews. Reply guidelines are the same as for service reviews per the Reviews & Ratings Policy.
- Bubba's Liability
9.1 Bubba as Intermediary
Bubba's role in Product transactions is limited to:
- Hosting Product listings.
- Processing payments via Adyen.
- Facilitating communication between buyers and Sellers.
- Providing dispute assistance.
Bubba is not liable for:
- Product quality, safety, description accuracy, or legality — this is the Seller's responsibility.
- Shipping delays, lost packages, or delivery issues — contact the Seller first.
- Product defects or non-conformity — claims are directed to the Seller under the legal guarantee.
- Seller insolvency or cessation of business.
9.2 Dispute Assistance
If you are unable to resolve a dispute with a Seller directly, Bubba offers mediation assistance:
- Contact legal@bubba.pet with details of the dispute and your order number.
- We will attempt to mediate between you and the Seller.
- We may, at our discretion, issue a refund from held funds if the Seller fails to respond or comply with their legal obligations.
9.3 Content Moderation
Product listings are subject to the content moderation provisions of the DSA Transparency page. You can report a Product listing that you believe contains illegal content or violates our policies using the notice-and-action mechanism described there.
- Intellectual Property
10.1 Product Content
Sellers retain intellectual property rights over their Product listing content (descriptions, photographs, branding). By listing Products on Bubba, Sellers grant Bubba a non-exclusive, royalty-free license to display, reproduce, and distribute listing content on the platform for the purpose of operating the marketplace.
10.2 Counterfeits
Bubba does not tolerate counterfeit products. If you believe a Product listing infringes intellectual property rights, use the content reporting mechanism described in our DSA Transparency page or contact legal@bubba.pet.
- Dispute Resolution
11.1 Internal Resolution
We encourage you to resolve disputes with the Seller directly through the platform messaging system. If that fails, contact legal@bubba.pet for mediation assistance.
11.2 EU Online Dispute Resolution
In accordance with EU Regulation 524/2013, you can submit disputes to the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
11.3 Alternative Dispute Resolution
You may also use the alternative dispute resolution body:

11.4 Right to Court Proceedings
Nothing in these Product Terms restricts your right to bring proceedings before the courts of your habitual residence, in accordance with EU consumer protection law.
- Changes to These Terms
We may modify these Product Terms from time to time. Material changes will be communicated at least 30 days in advance via email and/or in-app notification. Continued use of the marketplace after the effective date constitutes acceptance. If you disagree with any changes, you may stop using the marketplace.
- Severability
If any provision of these Product Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
